For simplicity hereafter the Flex buyer (you) will be referred to as “Customer”, Flexible Purchase Plan as “Flex”, and Instrument, Bow and Case will be “Outfit”.

Ownership
Customer takes full ownership of Outfit at time of shipment and is responsible for standard maintenance.

Payments
Customer’s credit card will be charged on the 1st or 15th of every month for 24 months until Customer returns the Flex purchase, completes the 24 months, or agrees to a buyout. The initial payment will include postage & handling costs and will be charged the day the outfit ships.  Michigan sales tax will be added to Michigan resident’s Flex payments.

IMPORTANT: Customer is responsible for promptly notifying SHAR of any changes in their credit card information such as expiration date, billing address, etc.  In the event of a credit card being declined at the time of scheduled automatic payment, SHAR will bill Customer for monthly Flex payments, plus a $5 processing fee, until updated credit card information is provided by Customer.

Late Fees
Payments 30 days overdue will be charged an additional $15/month late fee.

Returns and Exchanges
Customer may return Outfit within the first 30 days for a full refund of the purchase price, excluding shipping & handling.  Thereafter, Customer may return Outfit at any time and is not obligated to make future payments.  Returns received before the scheduled Flex payment date will not be charged for the next month’s payment. Customer must allow three business days for processing of returned Flex outfit.  Customer is responsible for the full month’s payment and payments will not be “pro-rated”. SHAR reserves the right to charge Customer for repair or replacement of Outfit components returned with excessive wear and tear, up to but not exceeding the retail value of the Outfit components.

Customer may exchange the Outfit at any time and for any reason for a larger sized Outfit or one of higher price.  Customer’s original Flex agreement will be ended, and a new 24-month agreement will be started on the new Outfit.  All Flex purchase credit that Customer has accumulated on the original Outfit will remain on account for future use so long as new Flex Purchase is made within 30 days of return. SHAR reserves the right to charge Customer for repair or replacement of Outfit components returned with excessive wear and tear, up to but not exceeding the retail value of the Outfit components

Extended Flex Warranty
Shar agrees to replace broken strings and repair or replace damaged Outfit components when breakage or damage is deemed by SHAR to have been caused by defects in workmanship or materials. Warranty does NOT cover accidental damage or theft. SHAR will not pay for any unauthorized repairs, unauthorized purchases, rentals or any other form of replacement including shipping and handling charges or any related costs of any Outfit component or part at any time.

Flex Credit
Fifty percent of all Flex payments accumulate as Flex-Credit which may be used towards the direct purchase (not a Flex purchase) of any Outfit of greater value within 90 days of return of outfit or all accumulated credit is considered null and void.  After the 24th and final payment the customer has 90 days to use their accumulated flex credit. “Greater value” is defined as the next pricing level of our current instruments  (example: accumulated credit from a Franz Hoffman Amadeus violin can go towards a purchase a Franz Hoffman Prelude violin or higher).

Customers who exchange their original Flex Purchase Outfit for another Outfit retain their accumulated Flex Credit and continue to accumulate Flex Credit on their new Flex Purchase so long as a new Flex Purchase is made within 30 days of receipt of return of original Flex.  Flex Credit is non-transferable and must be used towards the same type of instrument (violin, viola, cello or bass).  Flex Credit can not be combined (example: two different players cannot return their instruments and combine their accumulated Flex credit to purchase one Outfit, even if both Outfits were paid for by the same Customer).

Buy-out option
At any time Customer may buy-out the remaining payments of their Flex Purchase by paying a percentage (Violin 50%, Viola 55%, Cello 60%) of the total of the remaining payments.  Flex Credit may not be used towards the buy-out and all Flex Credit accumulated is considered null and void at the time of buy-out.  The Outfit purchased in a buy-out may be traded-in at any time for an instrument of greater value.  The trade-in allowance will be the same percentage allowed for trade-ins of the same level instrument if purchased new at the time of the buyout.
